Limited Warranty for Temporary Car Shelters and their Components

Abris Mondial guarantees its product including components against defects in material and workmanship as follows:

  • 3 year limited warranty for the 240 GSM fabric
  • 2 year limited warranty for the 240 GSM fabric for the industrial and commercial
  • 1 year limited warranty for the 190 GSM fabric
  • 1 year for the windows
  • 10 years for the metal

This warranty is non-transferable and is valid only if the following criteria are met:

  1. The shelter was installed and maintained as per the instructions provided by Abris Mondial.
  2. The buyer produces a copy of the invoice or proof of purchase and a picture of the damaged part, within 30 days of purchase or within the 48 hours following the initial installation.
  3. The shelter was not damaged due to negligence, improper maintenance or improper installation. Abris Mondial, at its discretion, will repair or replace the product free of charge.
  4. The buyer will be responsible for all costs of transportation for the shelter and/or its accessories.
  5. Abris Mondial shall not be liable for any costs incurred to replace or repair the product under warranty such as, but not limited to transportation, removal or installation.

This warranty does not cover

  1. Damages caused by
    • accidents
    • animals
    • extended exposure to the sun
    • extreme weather conditions
    • ice
    • improper installation
    • improper storage (ensure the fabric is dry, free of leaves and dirt or debris when storing)
    • fire
    • snow accumulation
    • vandalism
    • vegetation
    • unforeseeable events.
  2. Damages to people and property
  3. Normal wear and tear as well as discoloration of any of the components of the shelter.
  4. The seams connecting the parts of the fabric render it impossible to guarantee complete sealing. Water infiltration does not constitute a manufacturing defect.
  5. Note: Temporary car shelter fabrics are designed for winter use.

Important safety warnings:

To reduce the risk of collapse:

    • Keep the roof and all sides clear of snow and ice at all times

To reduce the risk of the shelter being blown away:

    • Use guide cables or anchors at all times as per the installation instructions
    • Keep the doors closed

CAUTION – DO NOT USE CONCRETE BLOCKS TO ANCHOR DOWN THE SHELTER AS THIS IS NOT ADVISABLE.

To avoid the risk of fire:

    • Do not keep flammable products under or near the shelter
    • Do not use the shelter for activities for which flammable products are used (eg smoker, barbecue, industrial equipment, etc.).

LEASE AGREEMENT

(referred to as “LESSOR”)
AND:
(LESSEE)

A. LESSOR AND LESSEE AGREE AS FOLLOWS:

1. LESSOR will deliver and install (weather permitting) the LESSEE’S temporary winter shelter(s) at the LESSEE’s
address on or after the permitted start date as defined by municipal by-laws (permitting the installation of temporary winter shelter(s).
2. LESSEE will allow LESSOR full and unrestricted access to the area(s) designated for installation of the temporary winter shelter(s).
3. LESSEE gives full verbal and/or written consent to the LESSOR allowing the use of 12” spikes and/or permanent anchors and/or wire locks to properly secure the temporary winter shelter in the designated area (driveway and/or house).
Once installed, permanent anchors and/or wire locks become the property of the LESSEE paid for by the LESSEE at current market prices as described in LESSOR’s “SALES ORDERS” annexed as a schedule to this Lease Agreement.
4. LESSOR will remove and store (weather permitting) the leased temporary winter shelter(s) from the LESSEE’S address on or before the permitted removal date as defined by municipal by-law for said address.

B. PAYMENT AND OTHER TERMS

1. During the term of the lease, LESSEE agrees to pay in full the sum as shown in the “TOTAL” column in the LESSOR’S “SALES ORDER” annexed as a schedule to this Lease Agreement. LESSEE agrees to pay 50% of the sum upon signing of this lease and 50% two days (48 hours) prior to the scheduled installation date.
2. No reimbursement will be issued as a result of the premature removal of the winter car shelter at the client’s request.
The LESSEE must also assume responsibility for the payment of services rendered by the LESSOR in the event of the premature removal of the car shelter.
3. In the case of non-payment, in part or in whole, the LESSOR can, without warning or formal notice, take back possession of all the rented materials related to the rental of the car shelter, cancel the present contract and keep all monies received.

4. In the event that the LESSEE cancels the contract, the LESSOR reserves the right to keep monies received, including deposits.

C. ADDITIONAL TERMS AND CONDITIONS

1. Good Condition:
a. LESSEE acknowledges having received delivery of the leased temporary winter shelter(s) in good and
useable condition, except as otherwise expressly stated in a written document signed by LESSOR and
LESSEE or their respective agents.
b. LESSEE agrees to return said leased temporary winter shelter(s) in the same condition that existed at the time of delivery to the LESSEE, normal wear and tear excepted.

2. Damaged, Destroyed or Lost:
a. LESSEE shall be liable for all damages to and loss of leased temporary winter shelter(s) occurring
between its delivery to LESSEE and its permanent removal and return to LESSOR or LESSOR’s agent.

3. Snow Removal:
a. LESSEE is responsible for the removal of any snow buildups on the roof of the temporary winter
shelter(s) and must ensure that there is no danger of the shelter collapsing from any buildup of non-
removed snow.

4. Damaging Winds and/or Snowstorms:
a. It is important to keep the doors of the temporary winter shelter closed during a snowstorm and/or
when winds are blowing moderate to strong.

5. Essential Conditions:
Each of the following is an essential condition for the continuance of the lease:
a. That every temporary winter shelter at all times remains in the possession of LESSEE or of its
authorized agent and under LESSEE’S control.
b. That payment and all additional fees, costs and charges mentioned in this agreement are paid in
full on their due date, and
c. That LESSEE refrain from performing any modifications to, repair or maintenance of any temporary
winter shelter unless expressly authorized to do so by LESSOR.

6. LESSOR’S Property:
a. Every temporary winter shelter, shall, at all times, remain the property of LESSOR and LESSEE
undertakes to advise any other party of that fact.

7. LESSOR shall not be liable for:
a. Any bodily injury (including death) suffered by LESSEEE, or any other persons, or any other injury
including, without limitation, any damages to, or loss of any object stored in any temporary winter
shelter, occurring during the lease and before the temporary winter shelter is returned to LESSOR and
resulting from the lease or use of the temporary winter shelter by LESSEE, even if the negligence of
LESSOR contributed to those injuries.

8. Insurance:
a. In order to reduce the risk of financial loss resulting from the provisions in this lease, LESSEE agrees to purchase its own appropriate insurance coverage.

9. Indemnification by LESSEE:
a. If any person claims damages from LESSOR caused by a temporary winter shelter and its use during the term of this lease and before that temporary winter shelter is permanently returned to LESSOR, LESSEE shall indemnify LESSOR for all losses, costs, and expenses, including legal fees and disbursements incurred, and any injuries suffered by LESSOR in connection with such a claim.

10. Taxes, charges and costs of infractions:
a. LESSEE shall pay all taxes and charges arising out of, or incident to, the use of every temporary winter shelter until permanently returned to LESSOR, including any amounts resulting from infractions under the Municipal by-laws affecting said shelters, as amended, and other applicable laws or regulations.

11. Lost or destroyed:
a. LESSEE’S obligation to pay for the replacement (including service charges and fees) for any winter
shelter that is damaged, lost or destroyed shall terminate as of the day when LESSEE furnishes proof of
such fact to LESSOR, together with the payment of the replacement value thereof, which shall be the
value originally paid for the winter shelter(s).

12. No assignment or sub-letting:
a. The LESSEE may not assign this lease, in whole or in part, nor sublet any of the temporary winter
shelter(s) to others.

13. Entire agreement:

a. This agreement constitutes the entire contract of lease between the parties, and there are or have been no representations, warranties, conditions or collateral agreements, expressed or implied, statutory or otherwise, with respect to any leased temporary winter shelter or to the rights of the parties to the present agreement other than as herein contained.

14. Subsequent modifications:

a. No changes, alterations, modifications and/or additions to the present agreement shall be valid
unless said changes, alterations, modifications and/or additions are in writing and signed by both
parties to the present agreement.

15. French language :
a. THIS AGREEMENT HAS BEEN DRAFTED IN ENGLISH AT THE EXPRESS REQUEST OF
BOTH PARTIES.
